In Romania, certain provisions of the GDPR have been implemented by Law 190/2018 and by certain decisions adopted by the National Authority for Supervision of the Processing of Personal Data (“ANSPDCP”). GDPR is updating the principles established two decades ago by Directive 95/46 / EC, which ceased to apply once the GDPR entered into force.
Unlike previous legislation, the GDPR emphasizes the rights of the person whose data are processed, such as the right to be informed about the operations by which personal data are processed, what are the data processed, on what grounds they are processed, for what duration are stored and under what conditions they can be accessed / deleted / rectified, etc. The GDPR is not just about the right to be forgotten. The right to delete personal data is not absolute and cannot be exercised at any time, but depends on the exact circumstances in which the data was collected, the purpose of the collection and the basis on which it was collected. Personal data in the CV or Letter of Intent may be transferred to government and regulatory agencies, national social security houses, courts and other government authorities, in accordance with the provisions of applicable law, pursuant to Art. 6 (1) (c) GDPR, and to consultants external data controllers (for example, lawyers, accountants, auditors, etc.) based on Art. 6 (1) (f) GDPR.
Retention periods for data transmitted for recruitment purposes
